These Terms & Conditions apply to the supply of products by REAL SCENES / Nathaniel Foster ("we," "us," or "our") to you when you make a purchase via our website www.realscenes.org (the "Site").
Please read these Terms & Conditions carefully before you submit your order to us. They explain who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. We amend these Terms & Conditions from time to time. Every time you wish to use our site or place an order, please check these Terms & Conditions to ensure you understand the terms that apply at that time.
1. Information About Us and How to Contact Us

2. Our Contract With You
2.1. The display of products on our online store does not constitute a legally binding offer; it is a non-binding online catalogue only. 2.2. After selecting your desired products by adding them to your basket, you will be presented with an order overview. Here, you can review all provided information, make changes, or correct any details. 2.3. By clicking the "Buy now" (or similar) button, you submit your order details to us and make a binding declaration to purchase the products listed. 2.4. We will automatically accept your offer upon receipt of your order. Immediately after sending your order, you will receive an email with an order and contract confirmation, which will list the details of your order.
3. Your Rights to Cancel and Our Cancellation Policy
3.1. No right to change your mind for custom or made-to-measure products: * Please note that artworks with custom mounting/framing (e.g., Collector's Edition prints with unique frames) as well as unmounted/unframed photo prints that are custom-produced to your individual specifications (e.g., printed on demand in a specific size/finish chosen by you) are excluded from the right to cancel or withdraw. This is in accordance with Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which states that the right to cancel does not apply to goods that are made to the consumer's specifications or are clearly personalised. You are responsible for ensuring that these specifications are correct.
3.2. Your general right to change your mind (for non-custom products, if applicable): * For products that are not custom or made-to-measure, you have the right to cancel this contract without reason within 30 days after the day you (or someone you nominate) receives the products. * If your order is split into several deliveries over different days, this 30-day period begins after the day you (or your nominee) receives the last delivery. * If your products are for regular delivery over a set period, this right applies until 30 days after the day you (or your nominee) receives the first delivery of the goods.
3.3. Other rights to cancel the contract: * You may have the right to cancel this contract if what you have bought is faulty or misdescribed. * You have the right to cancel this contract if we have delivered the products late. * You have the right to cancel this contract where we change these terms.
3.4. Ending the contract where we are not at fault and there is no right to change your mind: * In all other cases where you wish to end the contract before it is completed (and we are not at fault, and you do not have a right to change your mind under clause 3.2), you can still do so, but you may have to pay us reasonable compensation for the net costs we will incur as a result. The contract will end immediately, and we will refund any sums paid by you for products not provided, after deducting this compensation.
3.5. How to exercise your right to cancel: * To exercise your right to cancel under clause 3.2, you must inform us of your decision to cancel in a clear, written statement (by letter or email, for instance) within the allotted cancellation period. * Our contact details for cancellation are: nathanfoster@realscenes.org. * The deadline for the right to cancel will be met as long as your statement indicating you will be exercising the right to cancel is sent within the cancellation period.
3.6. Refunds following cancellation (exercising your right to change your mind): * Should you cancel the contract, we will refund all payments received from you, including our standard delivery costs (but excluding any additional costs from selecting a different type of delivery than the standard, cost-effective shipping we offer). * If we have not offered to collect the products, your refund will be made within 14 days from the day on which we receive the product back from you or (if earlier) the day you provide proof that you have sent the products back to us. * In all other cases, your refund will be made within 14 days of you telling us you have changed your mind. * We may make deductions from the price of the products when refunding you if the value of the product has been reduced as a result of your improper handling of the products.
3.7. Returning products after ending the contract: * If you end the contract for any reason after the products have been dispatched to you or you have received them, you must return them to us in the original packaging. * If you are exercising your right to change your mind, you must send the products off within 14 days of the date you inform us of the cancellation. This deadline will be met as long as you dispatch the goods to us within this 14-day period.
3.8. Who pays for returns: * We shall bear the costs for returning products if the products are faulty or misdescribed, if you are ending the contract because we have told you of an upcoming change to the product or these terms, a delay in delivery due to events outside of our control, or because you have a legal right to do so as a result of something we have done wrong. * In all other circumstances (including where you have exercised your right to change your mind), you shall bear the direct costs for returning products. Due to the delicate nature of fine art prints, they typically cannot be returned by normal post. Please contact our Customer Service at nathanfoster@realscnenes.org for information on
arranging return shipment via a specialized courier.
4. Delivery
4.1. Unless agreed otherwise, delivery will be to your specified address. Please refer to our Delivery page for detailed information on delivery times, methods, and costs: https://www.realscenes.org/delivery. 4.2. Delivery times provided are approximate.
5. Prices, Payment, and Order Default
5.1. The price of the products is stated online and includes VAT where applicable. Shipping costs are not included in the displayed product price and will be charged additionally. Information about shipping costs is contained in our Delivery page. 5.2. Our current accepted payment methods and their conditions are published on our website: https://www.realscenes.org/accepted-methods-of-payment. 5.3. When paying via third-party payment services (e.g., PayPal), you will be automatically redirected to their platform after completing the order process. The payment process is then governed by the terms of that payment service. 5.4. Payment for products is typically due upon placing the order (pre-payment via credit/debit card). 5.5. If you do not make any payment to us by the due date, we may charge interest to you on the overdue amount at a rate of 3% a year above the base rate per annum published by the Bank of England. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us this interest together with any overdue amount.
6. Retention of Title
Until full and final payment for the delivered products, the products shall remain the property of REAL SCENES / Nathaniel Foster.
7. Liability
7.1. If we fail to comply with these Terms & Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or our failing to use reasonable skill and care. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen (e.g., if you discussed it with us during the sales process). 7.2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability: (a) for death or personal injury due to our negligence or the negligence of our employees, agents or sub-contractors; and (b) for breach of your legal rights in relation to the products, including the right to receive products which are as described and match information we provided to you, of satisfactory quality, fit for any particular purpose made known to us, and supplied with reasonable skill and care, and for defective products under the Consumer Protection Act 1987. 7.3. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business, or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
8. Your Legal Warranty Rights (Consumer Rights Act 2015)
The Consumer Rights Act 2015 states that goods must be as described, fit for purpose, and of satisfactory quality. During the expected lifespan of your product, your legal rights generally entitle you to the following:

(a) Up to 30 days: If your products are faulty, you can get a full refund.

(b) Up to 6 months: If your products can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.

(c) Up to 6 years: If your products do not last a reasonable length of time, you may be entitled to some money back.
Please check the products immediately after delivery and take prompt action if defects are discovered.
9. No Granting of Rights
By purchasing a photographic print, you are only acquiring material ownership of that physical print. No other rights are granted or implied. Any reproduction (copying), dissemination, leasing, public exhibition, or other analogue or digital use of the image is not permitted unless expressly authorized by law or by prior written agreement from REAL SCENES / Nathaniel Foster. However, you are permitted to resell the physical print itself.

11. Applicable Law and Jurisdiction
These Terms & Conditions are governed by English law. You can bring legal proceedings in respect of the goods in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the goods in either the Scottish or English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the goods in either the Northern Irish or the English courts.
